12 Months of Mortgage Freedom Contest

Rules and Regulations

Eligibility

The “12 Months of Mortgage Freedom Contest” (the “Contest”) is open to entrants who are qualified mortgage customers of First National Financial LP (the “Contest Organizer”), and the entrant’s mortgage must not be in default of the terms and conditions of such mortgage, at the point during which the entrant is selected as a potential winner (see below for details regarding the draw dates). Entrants require a My Mortgage User ID and password to enter the Contest. To request your User ID and password contact Customer Service 1-888-488-0794.

All entrants must be legal residents of Canada and who are over the age of majority in their jurisdiction of residence at the time of entry. NO PURCHASE NECESSARY TO ENTER OR WIN.

Employees, directors and officers of  the Contest Organizer and its representatives, agents, advertising or promotional agencies, and anyone else involved in the development or execution of this Contest (collectively, the “Contest Parties”) and all members of any such director’s, officer’s, employee’s, representative’s, and agent’s household or immediate family (regardless of where they live) are not eligible to enter the Contest. In these Official Rules, “immediate family” means spouse, mother, father, brothers, sisters, sons, daughters and each of their spouses. Entrant’s mortgage with the Contest Organizer must be a residential mortgage to qualify (as determined by the Contest Organizer in its sole and absolute discretion on the basis of its records). Only entries received during the Contest Period will be eligible.
 

Accept Official Rules

Participation constitutes each entrant's full and unconditional agreement to be legally bound by these Official Rules (the “Rules”). The decisions of the Contest Organizer with regards to all matters of this Contest are final and binding. Winning a prize is contingent upon fulfilling all requirements of these Rules. 

Contest Period

The contest begins at 12:00am ET on October 1, 2017 and closes December 15, 2017 at 11:59PM ET (“Contest Period”). 

How to Enter

Participants can enter the Contest in one of two ways, by signing up for electronic annual mortgage statements, (“e-statements”), or if they have signed up for e-statements prior to the Contest Period, by submitting an essay, respectively as follows:

  1. Enter by Signing Up for e-statements. To enter by signing up for e-statements, login to My Mortgage (www.firstnational.ca/mymortgage) and follow the on-screen instructions to sign up to receive e-statements. Once you have selected that you wish to receive e-statements you will receive one (1) entry into the Contest.  
  2. Enter by Essay. If you have signed up for e-statements prior to the Contest Period, during the Contest Period, you may enter the Contest and receive one (1) entry by submitting your full name, mailing address, telephone number, First National mortgage number and  answer to the question “What would you do with a mortgage free year?” to: Marketing@firstnational.ca (maximum 150 words).   

Entry Limit

Entries through either method of entry are “Entries” and individually, an “Entry”.  There is a limit of one (1) Entry per mortgage during the Contest Period. For greater certainty and the avoidance of any doubt, you can only use one (1) email address linked to a My Mortgage account to enter the Contest. If it is discovered by the Contest Organizer (using any evidence or other information made available to or otherwise discovered by the Contest Organizer) that any person has attempted to: (i) exceed any of the limits stated in these Rules; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Contest Organizer. Your Entry may be rejected if (in the sole and absolute discretion of the Contest Organizer) the it is not fully completed with all required information and submitted and received in accordance with these Rules during the Contest Period. The Contest Organizer is not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).     

Verification

All Entries are subject to verification at any time and for any reason. The Contest Organizer reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Organizer – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry or other information submitted (or purportedly submitted) for the purposes of this Contest; and/or (iii) for any other reason the Contest Organizer deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Contest Organizer within the timeline specified by the Contest Organizer may result in disqualification in the sole and absolute discretion of the Contest Organizer. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).

Prizes and Winner Selection

There are a total of four (4) prizes (the “Prizes”) available to be won during the Contest Period: three (3) monthly prizes (the “Monthly Prize”) and one (1) grand prize (the “Grand Prize”).

Each Monthly Prize consists of $1,000 CAD applied to the applicable winner’s mortgage (as determined by the Contest Organizer in its sole and absolute discretion on the basis of its records). The number of Monthly Prizes will decrease throughout the Contest as they are awarded.

The Grand Prize consists of: (i) the applicable winner’s mortgage payments paid by the Contest Organizer for twelve (12) months (not including property tax, life insurance or home warranty payments) up to a total maximum of $25,000 CAD; and (ii) the mortgage broker (who, in order to be eligible to receive this element of the Grand Prize, must: (a) be a resident of Canada who has reached the legal age of majority in his/her province/territory of residence; (b) be a mortgage broker in good standing in his/her province or territory of residence and remain active during the Contest Period; and (c) must not have received a prize in connection with the 5,000 thank yous contest  that is sponsored by First National Financial LP) who referred the confirmed Grand Prize winner to the Contest Organizer (as determined by the Contest Organizer in its sole and absolute discretion on the basis of its records) (the “Broker”) will receive a $5,000 CAD gift card or voucher of a company with operations in Canada (the applicable gift card or voucher provider to be agreed between the Sponsor and the mortgage broker, with the Sponsor having sole and absolute discretion if a gift card or voucher can be accommodated) (the “Gift Card”). The Gift Card will be subject to the terms and conditions of the gift card/voucher provider. 

The Broker is solely responsible for all other costs and expenses that are not included in the Gift Card descriptions above, including, but not limited to, any tax consequences associated with the receipt of the Gift Card, such as declaring the Gift Card as income. The present document does not and should not be considered to provide advice as to the tax or financial consequences to you of receiving a Gift Card. The Broker should seek independent tax and financial advice as to any tax or financial obligations that may arise or result from his/her receipt of the Gift Card and, or subsequent use of the Gift Card as described herein or otherwise. The Broker is responsible for complying with any rules his/her employer may have regarding the acceptance of prizes. For greater certainty and the avoidance of doubt, the Gift Card must be accepted as awarded and will not be substituted for an amount of money. In the event the Broker is ineligible to receive the Gift Card (as determined by the Contest Organizer in its sole and absolute discretion), the Contest Organizer reserves the right, in its sole and absolute discretion, to randomly select an alternate mortgage broker to receive the Gift Card from among the mortgage brokers who respectively referred the confirmed Monthly Prize winners to the Contest Organizer (in which case the provisions in these Rules that apply to the Broker shall apply to such newly selected mortgage broker).

Each Monthly Prize will be paid in the month immediately following the month in which it is awarded in accordance with these Rules. Each Monthly Prize will not be considered a lump sum privilege payment and will not reduce the privilege allotment indicated in the entrant’s mortgage documents.  The Monthly Prize winners will still be required to make their regular monthly mortgage payment(s) for the month.

The Prizes are not transferable and must be accepted as awarded and shall not be exchanged for an amount of money.  Any federal, or provincial and/or local taxes/duties are the sole responsibility of the winners. Should a winner refuse to accept his/her Prize, the Contest Organizer, its member financial institutions, their affiliated companies and advertising agencies are released from any obligation related to such Prize.

Limit of one (1) Monthly Prize per person.
 

Draw Dates

On each of the dates set out in this section, at approximately 10:00 a.m. ET at First National Financial LP corporate head office, 100 University Avenue, North Tower, Suite 700: (a) in respect of the Monthly Prizes, one (1) eligible Entry will be selected by random draw from amongst all eligible Entries received prior to the entry cut off for the applicable Draw Date; and (b) in respect of the Grand prize, one (1) eligible Entry will be selected by random draw from amongst all eligible Entries received prior to the entry cut off for the applicable Draw Date.

For greater certainty, non-winning eligible Entries carry forward to be eligible on subsequent Draw Dates. There is a limit of one (1) Prize per mortgage. 

Odds

Chances of winning are dependent upon the total number of eligible Entries received within the Contest Period, prior to the entry cut off for the applicable Draw Date.

Potential Winners

A potential winner is not a winner of any Prize unless and until the potential winner’s eligibility and the potential winning Entry has been verified and the potential winner has been notified that verification is complete. The Contest Organizer will not accept screen shots, affidavits or other evidence of winning in lieu of its validation process.

Each potential Prize winner (and the Broker) will be notified by telephone or e-mail. In order to be declared a winner, each potential Prize winner (and the Broker) must first correctly answer, unaided, a time-limited, arithmetical, skill-testing question to be administered by mail, email, or by telephone at a pre-arranged, mutually convenient time, and then sign and return the Contest Organizer’s form of standard declaration and release form (the “Release Forms”). If the mortgage selected is a joint mortgage, the mortgagee designated as the entrant on the on-line Entry form must answer the skill-testing question, but all mortgagees must sign the Release Forms. If a potential Prize winner is not able to correctly answer the skill-testing question or fails to complete, sign and return any of the aforementioned documents within five (5) business days after notification, such potential winner will be disqualified (and will forfeit all rights to the applicable Prize) another eligible entrant may be randomly selected at the sole discretion of the Contest Organizer and the process outlined above will apply to such newly selected entrant. 

If the Broker winner is not able to correctly answer the skill-testing question or fails to complete, sign and return any of the aforementioned documents within five (5) business days after notification, the Broker will be disqualified and will forfeit any rights to the Gift Card and the Contest Organizer reserves the right, in its sole and absolute discretion, to randomly select an alternate mortgage broker to receive the Gift Card from among the mortgage brokers who respectively referred the confirmed Monthly Prize winners to the Contest Organizer (in which case the provisions in these Rules that apply to the Broker shall apply to such newly selected mortgage broker). 
 

General 

For Quebec Residents Only: Any litigation respecting the conduct or administration of this publicity Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

Subject to applicable law and to the approval of the Régie des alcools, des courses et des jeux, (“Régie”), Contest Organizer reserves the right to cancel, terminate, modify the rules or administration of or suspend this Contest in whole or in part without prior notice with no obligation or liability, including if for any reason the Contest is not capable of running as planned, whether due to technical failure, or computer virus, tampering, fraud, or corruption of security or proper administration of the Contest or other causes beyond the control of the Contest Organizer.  In such event, winners may be selected by randomly drawing from among all valid Entries received up to the time of cancellation, termination or suspension. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

The Contest Organizer reserves the right, subject to the approval of the Régie, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Contest Organizer, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Entry form, French Rules, website, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

Personal Data

All personal information submitted in relation to the Contest will be handled in accordance with Canadian privacy laws and the privacy policy of the Contest Organizer.  Your personal information will only be used in connection with the Contest, the Contest Organizer or your mortgage.  If you are selected as a winner, you consent and agree that the Contest Organizer may disclose to your mortgage broker that you have won this Contest, and for which month in question. Unless you otherwise agree, your personal information will not be used for any other purpose and will not be shared with anyone else.

Publicity

Except where prohibited, participation in this Contest constitutes consent to the use of a winner’s name, likeness, voice, opinions and biographical information for publicity, advertising, trade or promotional purposes in any media or manner, now known or hereafter devised, without payment, consideration, notice or approval.

Conditions of Participation

The Contest Organizer reserves the right in its sole discretion, to modify, cancel, terminate, and/or suspend the Contest and to disqualify any entrant who tampers with the entry process or violates these Official Rules.

The Contest Organizer reserves the right to, without prior notice and at any time,  remove participants or terminate this Contest, in whole or in part, or modify the Contest in any way, should any factor interfere with its proper conduct or impair the administration, security, integrity and fairness of play (as intended) of the Contest.  All Entries become the property of the Contest Organizer and will not be returned.

A person who attempts to undermine the legitimate operation of this promotion or to alter or damage a website may be subject to civil and/or criminal penalties and fines; and the Contest Organizer reserves the right to seek damages from any such person to the fullest extent permitted by law.

The decisions of the Contest Organizer with regards to all matters of this Contest are final and binding.

Limitations of Liability

By entering the Contest, entrants agree to release and indemnify and hold harmless the Contest Organizer, any of its advertising, promotional, publicity, production and judging agencies and its directors, officers, employees and agents from any claim, loss, expense (including legal fees) or other liability, including liability for personal injury, arising from participation in the Contest or the awarding, acceptance, use or misuse of a Prize.

By participating, entrants agree that the Contest Organizer is not responsible for: (i) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment, hardware, software or programming associated or used with the Contest; (ii) technical errors, defects, delays or failures of any kind, including without limitation malfunctions, interruptions or disconnections in communications lines, Internet or website access, hardware or software; (iii) digital or electronic disruptions, e.g., viruses or other security breaches; (iv) unauthorized human intervention, e.g., hacking; (v) technical or human error which may occur in connection with any aspect of the Contest; (vi) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an entrant’s participation in the Contest, or receipt or use of any prize; and (vii) lost, incomplete, illegible or garbled Entries, mail or transmissions, interrupted or unavailable network, server or other connections, miscommunications, computer virus, bugs, worms, tampering, unauthorized intervention, fraud, failed computer hardware or software or telephone transmissions or other errors or problems of any kind whether mechanical, human or electronic.
